Terms of service
Vertex 3D – Terms of Service
Last updated: October 2026
These Terms of Service apply to the use of the Vertex 3D website and to goods and services supplied by Vertex 3D, including 3D printing, additive manufacturing, CAD design, reverse engineering, prototyping, small-batch production and related services.
By placing an order, accepting a quotation, approving a design, submitting a file for manufacture or otherwise engaging Vertex 3D to provide goods or services, you agree to these Terms.
Nothing in these Terms excludes, restricts or modifies any rights or remedies that cannot lawfully be excluded, including rights under the Australian Consumer Law (ACL).
1. About Vertex 3D
Vertex 3D provides custom additive manufacturing and related design services from Australia.
Our services may include:
- custom 3D printing;
- functional prototypes;
- replacement and obsolete parts;
- small-batch and low-volume production;
- CAD modelling and design;
- reverse engineering;
- 3D scanning and scan-to-CAD services;
- design modifications for additive manufacture; and
- other related manufacturing services agreed with the customer.
The exact scope of each project will be determined by the applicable quotation, order confirmation, approved design or other written agreement.
2. Quotations and pricing
Quotations are based on the information available to Vertex 3D at the time they are prepared, including supplied files, quantities, materials, tolerances, finishing requirements and delivery requirements.
Unless otherwise stated on the quotation, quotations are valid for 30 days.
Prices may change if:
- the customer changes the design, quantity, material or specification;
- additional CAD or design work becomes necessary;
- the supplied file requires repair or modification;
- additional finishing or post-processing is requested;
- information originally supplied is incomplete or inaccurate; or
- the scope of the project otherwise changes.
Prices are stated in Australian dollars unless specified otherwise. Any applicable taxes will be identified where required.
Instant or automated website quotations are based on the information and manufacturing assumptions available to the quoting system. Vertex 3D reserves the right to review an automated quotation before manufacture and contact the customer if a file, orientation, geometry, material requirement or other factor requires clarification or repricing.
3. Orders and acceptance
An order is not considered accepted until Vertex 3D has confirmed the order or commenced the agreed work.
Vertex 3D may decline a project where we reasonably believe that:
- the requested product cannot be manufactured reliably;
- the supplied design presents an unreasonable safety risk;
- the request may infringe another person's intellectual property rights;
- the requested product is unlawful to manufacture or supply;
- appropriate materials or manufacturing methods are unavailable; or
- the project falls outside Vertex 3D's capabilities.
Where payment has already been made for a project that Vertex 3D subsequently declines before work begins, the appropriate amount will be refunded.
4. Customer-supplied files and information
Customers are responsible for ensuring that files, drawings, measurements, specifications and other information they provide are accurate and complete.
Where Vertex 3D manufactures directly from a customer-supplied or customer-approved file, the customer acknowledges that the finished product will substantially reflect the geometry and specifications contained in that file, subject to normal manufacturing tolerances.
Vertex 3D is not responsible for a design failing to function as intended solely because the design, dimensions or other information supplied or approved by the customer was incorrect or unsuitable, except to the extent that responsibility cannot lawfully be excluded.
Customers should clearly communicate any critical:
- dimensions;
- fits and clearances;
- tolerances;
- loads;
- temperatures;
- chemical exposure;
- UV exposure;
- operating environment;
- safety requirements; or
- other functional requirements
before manufacture begins.
5. File approval and design approval
Where Vertex 3D creates or modifies CAD geometry, we may provide drawings, images, renders, models or other information for customer approval.
Customer approval authorises Vertex 3D to proceed using the approved design.
Once a design has been approved, changes requested by the customer may constitute additional work and may incur additional design and manufacturing charges.
Approval does not remove any rights the customer may have under Australian Consumer Law where Vertex 3D's own goods or services fail to meet an applicable consumer guarantee.
6. CAD design and reverse engineering
CAD modelling and reverse engineering involve recreating or developing geometry based on the information, physical component, scan, measurements or specifications available.
Unless expressly agreed in writing, reverse-engineered geometry should not be assumed to be an exact reproduction at microscopic or metrological accuracy.
Factors including scanner accuracy, measurement access, manufacturing wear, deformation of the original component and incomplete geometry may affect the final model.
Where tight tolerances or critical dimensions are required, these requirements must be identified before work begins.
Additional revisions beyond the originally agreed scope may be charged separately.
7. Engineering and safety-critical applications
Unless expressly agreed otherwise in writing, Vertex 3D provides manufacturing, CAD and additive manufacturing services and does not provide professional engineering certification, engineering sign-off or regulatory certification.
The customer is responsible for determining whether a design is suitable for its intended application where suitability has not specifically been included within Vertex 3D's agreed scope of work.
Customers must inform Vertex 3D if a component is intended for a safety-critical application, including applications where failure could reasonably cause personal injury, significant property damage or other serious consequences.
Vertex 3D may decline to manufacture components intended for applications requiring engineering certification, regulated approval or testing that has not been provided.
Nothing in this section limits applicable consumer guarantees, including guarantees relating to due care and skill or fitness for an expressly disclosed purpose where those guarantees apply. Australian Consumer Law requires services to be provided with due care and skill and, in applicable circumstances, to be fit for an agreed purpose. ACCC
8. Materials
Vertex 3D may offer materials including standard and engineering-grade thermoplastics and fibre-reinforced materials.
Published material properties are generally based on manufacturer data and should be treated as indicative unless specific testing or certification has been agreed.
Actual component performance may be affected by:
- print orientation;
- layer height;
- wall thickness;
- infill;
- geometry;
- moisture condition;
- annealing or other post-processing;
- temperature;
- UV exposure;
- chemical exposure; and
- loading direction.
Where a customer chooses a material contrary to advice provided by Vertex 3D, the customer accepts the limitations explained to them, subject to rights that cannot be excluded by law.
9. Additive manufacturing characteristics and tolerances
3D printing is a layer-based manufacturing process. Finished parts may exhibit normal process characteristics including:
- visible layer lines;
- seam marks;
- support-interface marks;
- minor surface variation;
- minor dimensional variation;
- small colour differences between material batches; and
- minor cosmetic differences between separately manufactured parts.
These characteristics do not necessarily constitute defects.
If a project requires a specific dimensional tolerance, cosmetic standard, surface finish or colour match, that requirement must be agreed before manufacture.
Unless a tolerance has been specifically agreed, Vertex 3D will manufacture using tolerances considered reasonable for the selected additive manufacturing process, geometry and material.
10. Prototypes
Products described as prototypes are intended to assist with evaluation, fitment, development or testing.
A successful prototype does not necessarily establish that the design is suitable for final production, long-term use or a particular safety-critical application.
Customers are responsible for performing appropriate testing and validation before relying on a prototype as a production component unless testing or validation forms part of the agreed Vertex 3D service.
11. Intellectual property and customer authority
The customer retains ownership of intellectual property they already own in files, drawings, designs and other materials supplied to Vertex 3D.
By supplying material to Vertex 3D, the customer confirms that they have the necessary rights or permission to use, reproduce, modify and manufacture from that material.
The customer authorises Vertex 3D to use supplied files and information to the extent reasonably necessary to provide the requested service.
Where a customer asks Vertex 3D to copy, reproduce or reverse engineer an existing product, the customer is responsible for ensuring they have the legal right to request that work.
To the extent permitted by law, the customer is responsible for claims arising directly from intellectual-property infringement caused by materials or instructions supplied by the customer where Vertex 3D could not reasonably have known that those materials infringed another person's rights.
12. Vertex 3D-created CAD and design work
Unless otherwise agreed in writing, payment for CAD or design services gives the customer the right to use the final agreed deliverables supplied as part of the project.
Ownership and transfer of editable source files, manufacturing files, scan data, parametric design history or other working files should be agreed as part of the quotation where relevant.
Vertex 3D may retain internal working files and manufacturing records necessary to provide, reproduce or support the project.
13. Confidentiality
Vertex 3D will take reasonable steps to protect customer files, project information and confidential information supplied for the purpose of completing a project.
Customers should notify Vertex 3D before providing information that is particularly commercially sensitive or subject to a confidentiality obligation.
Where a formal non-disclosure agreement is required, this should be arranged before sensitive information or files are supplied.
14. Portfolio and marketing use
Vertex 3D will not intentionally publish customer-confidential information.
Where appropriate, Vertex 3D may photograph or display completed work for portfolio or marketing purposes unless the project has been identified as confidential or the customer has requested that it not be displayed.
For commercially sensitive projects, customers should advise Vertex 3D before manufacture.
15. Payment
Payment terms will be specified on the applicable quotation, invoice or checkout page.
Vertex 3D may require full or partial payment before:
- CAD work begins;
- materials are ordered;
- manufacturing begins; or
- completed goods are dispatched.
Work may be suspended where an amount has become overdue.
Ownership of manufactured goods does not transfer until the amount properly payable for those goods has been paid in full, to the extent permitted by law.
16. Lead times
Manufacturing and design lead times are estimates unless a specific completion date has been expressly agreed.
Lead times may be affected by:
- machine availability;
- material availability;
- design revisions;
- customer approval delays;
- manufacturing failures requiring a reprint;
- unusually complex geometry;
- quantity changes; and
- circumstances reasonably outside Vertex 3D's control.
Where no completion date has been agreed and Australian Consumer Law applies, services must be supplied within a reasonable time. ACCC
17. Cancellations and changes
Customers should contact Vertex 3D as soon as possible if they wish to cancel or modify an order.
Where manufacturing or design work has not commenced, Vertex 3D may agree to cancel the project and refund amounts not already reasonably incurred.
Once CAD work, material preparation, machine setup or manufacture has commenced, cancellation or modification may result in charges for work already performed and costs already reasonably incurred, subject to applicable law.
Custom-made goods generally cannot simply be returned because of a change of mind unless Vertex 3D agrees otherwise.
Consumer rights arising from faulty goods or services remain unaffected.
18. Returns, refunds and remakes
Returns, refunds, repairs and remakes are governed by the Vertex 3D Returns, Refunds & Remakes Policy, together with any rights available under Australian Consumer Law.
That policy forms part of these Terms.
Where there is any inconsistency between these Terms and a right that cannot lawfully be excluded under Australian Consumer Law, the statutory right prevails.
Consumer guarantees apply automatically where applicable and cannot be removed by contract terms. ACCC
19. Shipping and delivery
Any delivery date provided is an estimate unless expressly agreed otherwise.
Customers are responsible for providing accurate delivery information.
If a parcel is returned because incorrect or incomplete delivery details were provided, additional delivery costs may apply before the order is resent.
Customers should inspect delivered goods promptly and notify Vertex 3D of apparent shipping damage as soon as reasonably possible.
Risk associated with delivery will be determined in accordance with applicable Australian law and any agreed shipping arrangements.
20. Website and instant quotation tools
Information provided through the Vertex 3D website is general in nature and may be updated from time to time.
Automated quotations are intended to provide pricing based on the information processed by the quoting system. They do not replace manufacturing review where a design has unusual geometry, printability concerns, critical tolerances or other special requirements.
Vertex 3D may contact a customer before manufacture where an automated order requires clarification.
You must not attempt to:
- interfere with the operation or security of the website;
- upload malicious files or code;
- use the website for unlawful activity; or
- misuse automated quotation systems in a way that disrupts the service.
21. Limitation of liability
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, statutory right or liability that cannot lawfully be excluded.
Where liability can lawfully be limited, Vertex 3D's liability will be limited only to the extent that is reasonable and permitted by law having regard to the circumstances of the transaction.
Nothing in these Terms is intended to exclude liability where doing so would be unlawful.
22. Australian Consumer Law
Where the Australian Consumer Law applies, Vertex 3D's goods and services come with consumer guarantees that cannot be excluded by these Terms.
Products must, among other applicable guarantees, be of acceptable quality, match their description and be fit for an expressly disclosed purpose where the relevant guarantee applies. Services must be provided with due care and skill and, where applicable, be fit for an agreed purpose. ACCC
Businesses themselves can also qualify as consumers under the ACL in certain circumstances, including many acquisitions below the statutory threshold, so these protections are not limited solely to private retail customers. ACCC
23. Privacy
Personal information provided to Vertex 3D will be handled in accordance with the Vertex 3D Privacy Policy and applicable Australian privacy requirements.
Customer contact information will be used as reasonably necessary to provide quotations, process orders, communicate regarding projects and provide related services.
24. Changes to these Terms
Vertex 3D may update these Terms from time to time.
The Terms applicable to an accepted order will generally be those in effect when the order was placed or quotation accepted, unless a variation is agreed between Vertex 3D and the customer or required by law.
Changes will not retrospectively remove rights or obligations already accrued under an existing agreement.
25. Governing law
These Terms are governed by the laws of Victoria, Australia, and applicable Commonwealth laws of Australia.
The parties submit to the jurisdiction of the courts and tribunals having jurisdiction in Victoria, subject to any statutory rights relating to jurisdiction that cannot be excluded.
